High School Terms and Conditions
The following terms and conditions govern the contractual relationship between the organiser My Education (UK) Limited (hereinafter simply “MyEducation” or the “Company”) and the participant/applicant (the “Participant”) or his/her legal representative (the Participant’s legal representative such as the participant’s parent or legal guardian the “Legal Representative”) who purchases an exchange stay programme. References to a Participant within these Terms and Conditions includes reference to a Legal Representative where the Participant is a minor. If the Terms and Conditions are accepted by a Legal Representative, then they are deemed to be accepted by the Participant.
The agreement is entered into and executed in accordance with the applicable laws of England and Wales for contracts and consumer legislation. As the exchange stays are not covered by the Package Travel Regulations, this legislation will not apply to the programmes offered.
The purpose of the terms and conditions is to clarify the terms and conditions for participation, payment, cancellation and other relevant matters regarding the exchange stay.

Definitions
Confirmation Letter: the letter sent following the successful interview which sets out programme Price, payment dates, inclusions and exclusions of the programme and is binding on the signatories.
Exchange Programme: the placement of a United Kingdom based student or the placement of a student with British citizenship, with a host family overseas and enrollment into high school of that country, as described on the website from time to time and in the My Education brochure.
Force Majeure Event: any circumstances not within MyEducation’s reasonable control including but not limited to; acts of God, flood, drought, earthquake or other natural disaster; epidemic or pandemic; terrorist attack, civil war, civil commotion or riots, war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, or breaking off of diplomatic relations; nuclear, chemical or biological contamination or sonic boom; any law or action taken by a government or public authority, including imposing an export or import restriction, quota or prohibition; collapse of buildings, fire, explosion or accident; any labour or trade dispute, strikes, industrial action or lockouts ; non-performance by suppliers or subcontractors (including but not limited to airlines, travel operators or travel companies); or interruption or failure of utility service, or threats of any of the aforementioned.
Host Country: the location of the Exchange Programme.
Interest: interest charged daily at the rate of 11.75% per annum.
Partner Organisation: the overseas entity who MyEducation works with to be able to deliver the Exchange Programme.
Services: MyEducation will provide the following support and information services as part of the Exchange Programme, personal counselling to choose the right programme for the Participant, provision of a departure package, assistance with completing the application process, assistance with visa application and provision of the applicable documents, search for school within the chosen country and assistance with registration procedures, search and selection of host family, preparation course for the Participant and their family, arrangement of air fares for non-European destinations, help upon arrival to the Host Country by reception upon arrival and arranging transportation to the host family, arranging accommodation and lodgings with the host family, 24 hour assistance for emergencies in the United Kingdom and abroad, post travel meeting for students.
- General information about the programme
MyEducation offers Participants (and their Legal Representatives, if applicable) Exchange Programmes.
MyEducation will provide the Services in delivering the Exchange Programme and do so without warranting specific results and the content of its literature regarding the Exchange Programme and Services provided do not amount to representations.
Since the Exchange Programmes are of a residential, educational and cultural nature and they are permanently resident in the Host Country, the purchases are not considered to be travel products or packages.
The Exchange Programme requires the Participant to strictly adhere to local laws, culture, everyday customs, and rules of the host family, school and Partner Organisation. The Participant acknowledges that MyEducation has only limited influence on Partner Organisations, who make decisions based on compliance with local rules and practices. The Participant will be provided with details of such rules and practices applying to the Exchange Programme by the Partner Organisation prior to travel.
MyEducation does not accept any responsibility for incidents caused by the Participant’s actions that result in consequences such as legal, civil or criminal liability. The Participant and their Legal Representatives bear the consequences of such actions in accordance with both the Host Country’s and the laws of England and Wales.
The Participant and the Legal Representatives are responsible for ensuring that the Participant complies with all health and administrative requirements and recommendations (e.g. vaccinations, visas, passports, medical examinations, etc.) required by the Host Country’s authorities, schools or accommodations.
Failure to comply with these requirements, may lead to you being refused entry to the Host Country or a refusal of visa either before or during the Exchange Programme. My Education does not accept liability for your failure to comply, and if the refusal cannot be remedied this is considered to be a unilateral and voluntary cancellation or termination of the Exchange Programme by the Participant without responsibility for MyEducation.

- Programme price
The price for the Exchange Programme is based on airfares if travel is outside of Europe only (including airport taxes and fees), estimated costs in the Host Country (accommodation, schooling, insurance, etc.), and the exchange rate on the date of booking (“the Price”). You will be notified of the Price at the point of sign up and within the Confirmation Letter.
The Price is updated regularly according to exchange rates. MyEducation reserves the right to charge any currency surcharge that is considered to be part of the Price. Such a supplement does not in itself entitle the participant to cancel its participation in the Exchange Programme. MyEducation is not obliged to refund the Participant or his/her Legal Representative in the event of a change in currency to My Education’s advantage.
Details about what is included in the Exchange Programme can be found on MyEducation’s website. The information contained on the website is a guide only and the details vary depending upon the specific Exchange Programme selected and are subject to change from time to time. The specifics for each Exchange Programme will be provided in the Confirmation Letter. The Participant agrees that the majority of the costs included in the Price will be incurred prior to departure to the Host Country.
The Price does not include, unless otherwise stated, any fees to external providers in connection with the issuance of visas, passports and other local costs This also means that the cost of language tests, health insurance surcharges, required translations of school documents (which may potentially be required for visa applications or school enrollment), and travel expenses related to passport and visa applications are not included in the Price.
Furthermore, the Price does not include:
- Pocket money (for leisure activities, travel, school supplies, etc.).
- Vaccinations and medical tests/assessments required for admission to the programme.
- Surcharge for special dietary requirements, allergies or medical considerations.
- Airfares for European country travel.
- Costs associated with school which may include; subject fees, enrolment fees, uniform (if required).
Prices are valid for UK citizens only and prices are subject to change without notice. Only the prices stated on MyEducation’s website at the time of pre-registration apply.
After the contract has been concluded, the Price may be increased as a result of things outside of MyEducation’s control including but not limited to the following examples, rising fuel prices or higher taxes and duties. The Participant shall be notified of such changes no later than 20 days before the start of the Exchange Programme. If the price increases by more than 8%, the participant can withdraw free of charge by written notice by e-mail to MyEducation at the address provided within the terms and conditions no later than 7 days after the notice. If the Participant chooses to terminate based on a price increase the amounts Programme Price paid, minus an administration fee of GBP 75, will be refunded within 30 days.
MyEducation reserves the right to correct errors in prices or descriptions on the website and may cancel a booking in the event of technical or human error. The Participant must provide a valid email address, which is regularly checked by the Participant and his/her Legal Representative, as important documentation is sent by email. Communication via social media or messaging services is informal and not binding on MyEducation.
Any increase in Price either due to a currency surcharge or a rise in fuel prices, tax or duties, will form part of the price and referred to as the Price.
- Payment
The Price for the selected Exchange Programme is paid as follows:
- Deposit: 25% of the Price within 14 days of the date contained in the Confirmation Letter (“the Deposit”).
- Remaining amount: the balance of the Price less the Deposit will be paid in three installments of 25% each with the final instalment due before departure, the dates for all instalment payments will be notified to you in the Confirmation Letter (“Instalment Payments”).
All payments must be received before visa application documents (if applicable) can be submitted. Payment dates are set based on the Exchange Programme and destination, and they are confirmed in the Confirmation Letter. Compliance with payment deadlines is an absolute obligation of the Participant and any Legal Representatives.
If you fail to pay or delay in payment of any of the Instalment Payments when due MyEducation will send to you a reminder letter, My Education will charge a reminder fee of £25, and Interest will be charged on the late Instalment Payment(s) until payment is received.
This does not limit MyEducation’s right to claim compensation for further losses. In the event of continued non-payment MyEducation may suspend or terminate the Exchange Programme if payment is not made within 15 days of the first written demand. All consequences of this are borne by the Participant. If MyEducation has suffered a loss due to the Participant or their Legal Representative, MyEducation reserves the right to claim its losses, costs, expenses, damages from the Participant or their Legal Representative.
- Conclusion of agreement and right of withdrawal
All applicants for the Exchange Programme must submit a pre-registration form to MyEducation in order to be invited to a selection interview and must pay GBP 100 to cover the cost of assessing their application (the “Application Fee”).
Once MyEducation has received the pre-registration form and the Application Fee, the Participant will be invited to a selection interview with a MyEducation team member.
If the application interview is successful, MyEducation will send a Confirmation Letter via email about selection to the Participant and their Legal Representatives. This will contain information on how to access the platform to complete an online application form, or where to e-mail to request an e-mail copy of the application form. The application form must be completed by the Participant or their Legal Representative.
If the Participant is not selected, the Application Fee will be refunded.
The Confirmation Letter is binding on the signatories, subject to providing a 14-day right of withdrawal or cooling off period. Once this 14-day period has expired, signatories commit to:
- To pay the Deposit within 21 days from the date contained in the Confirmation Letter
- To return or submit the complete application form within 21 days from the date on the Confirmation Letter
MyEducation will commence its final application review process within 21 days from receipt of the 25% deposit and the complete application form. This process will involve MyEducation analysing the application and, if deemed necessary (entirely within MyEducation’s own discretion), grant, reject or provide a conditional acceptance based on certain elements that emerged during the interview (for example, but not limited to: false statements, inadequate school performance, inadequate language level, medical conditions). Any disclosed medical conditions will be dealt with in accordance with MyEducation’s policies. If MyEducation rejects the application a refund of the Deposit (but not the Application Fee) will be provided within 30 days. However MyEducation reserves the right to deduct from the Deposit its administrative expenses and costs incurred up to the point of rejection if the decision to reject is based on false statements made during the pre-registration, during the selection interview, or when filling in the application form or in case of cheating during assessment tests.
- Organiser/Responsibility
It is expressly acknowledged by the Participant and their Legal Representative when entering into these terms and conditions that My Education does not assume any responsibility for the relationship with embassies, consulates, administrative authorities, as well as the procedures required for obtaining visas, passports or other necessary administrative documents.
Although MyEducation will provide guidance and support for visa applications, the responsibility for applying for and obtaining such documents rests solely with the Participant and their Legal Representatives. MyEducation accepts no responsibility for refusal of visas by the Host Country’s authorities.
If the departure or the Exchange Programme is suspended or cancelled as a result of any breach of these terms and conditions, or negligence of the Participant or their Legal Representatives, you assume full responsibility for any costs associated with such suspension or cancellation including but not limited to travel costs or cancellation fees and MyEducation’s associated costs.
Stays and/or courses are arranged through local providers and sponsors. The name and contact details of the relevant service provider or sponsor will appear on the travel documents received by the Participant prior to departure.
MyEducation cannot be held responsible for the being unable to provide the Services as a result of the failure of service providers, Partner Organisations, or sponsors in the Host Country, airlines, insurance companies, or in the event of Force Majeure Event. Should such circumstances arise prior to departure and prevent the proper completion of the Exchange Programme or pose a risk to the participant’s safety and health, MyEducation does not accept responsibility for any form of compensation for any direct or indirect losses, damages, expenses or costs.
Using Images and Testimonies
All images, testimonials and other materials presented in brochures, on websites or in other documents are used for promotional purposes regardless of format or medium. Any statements contained within such promotional materials do not form part of the contract and are not representations or warranties.
- Cancellation, refund and right of withdrawal
- Cancellation by the participant before departure
All requests for cancellation of enrollment in the Exchange Programme must be notified to MyEducation by the Participant or their Legal Representative in writing by email sent to info@myeducationuk.co.uk
In case of cancellation after receipt of the pre-registration form and before the selection confirmation, the Administration Fee will not be refunded.
In case of cancellation within 14 days of MyEducation’s sending of the Confirmation Letter, the Administration Fee will not be refunded.
After the expiry of the 14-day deadline (see section 4) without notice of cancellation, the registration is considered confirmed and MyEducation may commence the provision of Services. If the Deposit is not paid within 19 days of sending the Confirmation Letter being issued, or if the full application is not returned within 21 days, the registration will be automatically cancelled. In such cases, MyEducation reserves the right to charge for its costs and expenses incurred in its provision of Services. This charge may be up to the sum of £900, such amount is considered to be a reasonable estimate of MyEducation’s costs and expenses.
In case of cancellation after payment of the Deposit, but before return of the complete application, the costs and expenses of MyEducation referred to at the above paragraph will be deducted from the Deposit.
If the Participant cancels after returning the complete application form but more than 6 months prior to departure, the contract will be terminated and the Participant the Deposit will not be refunded and will be deemed to be payment of My Education’s costs and expenses incurred up until that date. For cancellations received less than 6 months before departure, the cancellation fee is 50% of the Price..
MyEducation reserves the right to offset these allowances against any amounts already received from the Participant.
To protect the Participant in respect of cancellations prior to departure, MyEducation offers a cancellation guarantee (see section 6.3). For the price of the guarantee, please refer to the offer/booking module. After the Participant’s departure, no amount will be refunded if the stay is interrupted. The cancellation guarantee can be added to the Price for the sum of 9% of the Price as well as an application fee of £100 GBP, the terms of the cancellation guarantee do not apply unless it is purchased at the time of reservation and it is non-refundable.
Regional preference:
No guarantee of placement in a desired region is given, as locations depend on local availability and decisions of local sponsors. The probability of not being placed in the desired area is greater than of being placed. Failure to locate in desired region does not constitute a valid reason for cancellation and so such cancellations are not covered by My Education’s cancellation guarantee. If the Participant wishes to cancel in these circumstances, the above cancellation conditions apply.
- Cancellation by MyEducation
If MyEducation cancels the selection before the final admission is confirmed (but not for any of the reasons set out at paragraph 6.1 above, MyEducation will refund the Deposit if paid.
In the event of cancellation of the registration by MyEducation (and not due to an external factor or a Force Majeure Events) after confirmation of the final admission, MyEducation accepts that the Participant may have incurred some material costs, such as airfares, travel or visa costs. The Participant is obliged to mitigate its losses and seek to rearrange or accept an alternative suitable Exchange Programme. However, if MyEducation is unable to rearrange the Exchange Programme or provide a suitable alternative MyEducation will reimburse the Participant for its reasonable and direct material costs caused by the cancellation upon receipt of proof of purchases.
MyEducation may decide to cancel an Exchange Programme at any time if it is assessed that the conditions for the stay are changing for the worse (health conditions, political conditions, negative travel advice from the Ministry of Foreign Affairs, etc.) without liability on the part of MyEducation. In this case, the Participant must respect this decision.
- MyEducation Cancellation Guarantee
It is possible and advisable to take out the “MyEducation Cancellation Guarantee” upon registration, which covers the costs of cancelling the Exchange Programme in the event of, among other things, health problems of the Participant or a close family member, as well as for school reasons.
The price of the “MyEducation Cancellation Guarantee” is 6% of the price of the Exchange Programme that the participant has signed up for and must be paid in full upon registration, in addition to the application fee of £100 GBP.
MyEducation’s cancellation guarantee provides for you to cancel the Exchange Programme without additional fees being incurred (other than the cost of the Cancellation Guarantee) until departure, if the terms of the Cancellation Guarantee are met.
My Education’s Cancellation Guarantee covers cancellation of the contract in the following cases, provided that adequate medical certification or school documentation is provided:
- Death of the Participant or a first-degree relative (parents, siblings).
- Serious health problems of the Participant or a close family member (parents, siblings). The health problem must be notified in writing by the Participant / Legal Guardian and within 5 days of providing the notice – the participant must provide the relevant medical/health information proving the medical situation.
- Pre-existing medical conditions that reoccur or worsen and cause the Participant to be unable to continue with the Exchange Programme.
- Failure to participate in the Exchange Programme due to the repetition of a school year, which prevents the commencement or postponement of the Exchange Programme, or in the case of poor school exam results that require the Participant to take re-exams and the application is accompanied by the school’s results and an appropriate statement from the school confirming that the Participant cannot leave the school.
- Theft of the Participant’s identity documents required for the exchange within the last 72 hours before departure, accompanied by a police report, if it is proven that it is materially impossible to recover/replace these documents before departure and up to 15 days after the scheduled departure date.
- Duly documented inability of the Participant to reach the point of departure following severe natural disasters.
Excluded from coverage are cancellations and/or changes that are directly or indirectly due to reasons that cannot be objectively documented, or to mental illnesses or a pre-existing illness, as well as circumstances that are not explicitly mentioned in the above points.
If the conditions for the use of MyEducation’s Cancellation Guarantee are not met and/or if the stated reasons cannot be taken into account, the applicable cancellation conditions in MyEducation’s general terms and conditions will be applied for the calculation of the retained cancellation costs.

7. Programme changes
MyEducation reserves the right to do the following:
- To change the airline, flight route and times of departure and return.
- To change the Exchange Programme at the selected destination, if this is deemed necessary.
- To change the scheduled departure date.
My Education will provide as much notice as possible for any such Exchange Programme changes, however sometimes changes may be made up to 24 hours prior to the schedule departure date.
8. Travel duration and logistical information
The start date and exact duration of a stay may vary depending on several factors, including (non-exhaustive list):
- The Exchange Programme destination.
- My Education’s internal organisation (including transport, insurance, combination of stays in several countries, need to gather more participants, etc.).
- Requirements set by the local authorities of the Host Country (including length of stay rules related to reciprocity quotas and immigration rules).
- Requirements from the host institution, such as a school or school district.
- Requirements of the local organisation sponsoring the Participant’s stay.
- A Force Majeure Event that necessitates adaptation of the stay.
Unless a shorter term stay is selected, the duration of a school year typically ranges from 9 to 11 months, as well as a school semester from 4 to 5 months. The final duration is determined at My Education’s discretion and taking into account, inter alia, the external factors mentioned above.
The Participant or their Legal Representatives may not claim compensation, adjustment or reimbursement as long as the stipulated duration of stay is equal to or longer than the above-mentioned minimum durations.
In the event that MyEducation cannot comply with the minimum durations described for the chosen stay and set out in the Confirmation Letter (except in cases of Force Majeure or in case of early return due to the Participant’s own circumstances or behaviour / breach of rules), the difference in the length of the stay will be refunded on a pro-rata basis for the services not used.
Departure and return dates do not necessarily follow the start or end of the local school year but are set by MyEducation and its Partner Organisation based on factors such as visa requirements, local school conditions, flight availability, and internal organization.
- Visa and travel-related obligations
In the event that a visa is required for the Host Country, MyEducation will provide you with the necessary forms and instructions for the application process before departure. It is the responsibility of the Participant and their Legal Representative to apply for and pay for the visa, including any related expenses.
The Participant’s passport must be valid for at least six months after the end of the Exchange Programme.
Participants are encouraged to bring copies of important documents on the trip, including passports, visas, insurance policies, personal contact information, credit card numbers, and birth certificates.
MyEducation accepts no responsibility for the loss or theft of the Participant’s personal belongings during the stay.
If the Participant loses their passport during the Exchange Programme stay, they are responsible for all costs associated with obtaining a new passport. MyEducation is not responsible for lost or damaged luggage; This is the responsibility of the airline under the applicable regulations.
- Flight tickets and baggage rules
The Price for non-European destinations includes a return ticket from Heathrow, Gatwick, Manchester or Edinburgh Airport to the Host Country. The Participant must be travelling from one of these airports. Any excess baggage must be paid by the Participant at check-in. It is the Participant’s responsibility to familiarise themselves with the individual airline’s rules for baggage, including weight limits and fees.
The Participant is also responsible for any baggage fees for domestic flights in the Host Country.
9. Health conditions
The Participant is required to undergo a complete medical examination by a British doctor within 12 months prior to the scheduled departure date. The completed health certificate must be uploaded to the applicant’s personal profile in connection with the application process. The medical certificate must not have been issued earlier than one year before the date of departure.
The applicant’s admission to the Exchange Programme is conditional on MyEducation receiving and reviewing the information provided in the medical certificate. MyEducation reserves the right to revoke the approval of an applicant or participant if current or past health problems give rise to doubts as to whether the applicant will be able to complete the Exchange Programme.
The Participant is further required to receive all required vaccinations as may be prescribed by the authorities, the Host Country’s school, the state or the community in general. Information about the required vaccinations will be sent by MyEducation, and the Participant must ensure that these requirements are met before departure.
Missing or incorrect information about the Participant’s health, including both physical and mental conditions, may affect the Participant’s acceptance to the Exchange Programme as well as continued participation in the Exchange Programme. It is only MyEducation and its Partner Organisation that assesses and decides on possible repatriation early in the event of new information about the Participant’s health. In these circumstances the Participant will not be entitled to a refund.
The Participant is obliged to inform MyEducation immediately if there are any changes in their health. Failure to meet these requirements may have consequences for both admission and continued participation in the Exchange Programme. The Participant is also obliged to familiarise himself with the rules and regulations in force in the Host Country.
MyEducation reserves the right to terminate the Participant’s participation in the Exchange Programme if new or previous health arise during the school year.
10. Host families
Placement with a host family can take a long time, as many factors must be taken into account. These include, among other things, background checks, the time taken for families to decide to take on the role of host family may be later in the season, and some families may take time to choose the student they wish to host. Host families can receive payment, financial support to cover the costs of being a host family or be completely voluntary. These preparatory steps require time.
Participants should therefore be aware that whilst My Education will use its reasonable endeavors to secure a location in advance, sometimes information about their location may be received a few days before departure. In certain cases, if a permanent placement cannot be secured prior to departure, or if a previously found family withdraws, the Participant may be temporarily placed with another host family while the search for a permanent family continues. In some cases, host families can house several students at the same time, and students may experience being placed with more than one family during the Exchange Programme.
Host family experiences have a strong educational and culturally enriching character. Participants must therefore show flexibility and see any change of family as an opportunity to experience more aspects of the local culture. The facilities of a host family cannot be compared to a stay in a hotel, and the human aspect is central to the experience.
Host families often see Participants as part of the family. Therefore, it is expected that the Participant is included in daily life, including performing minor household chores, as a natural part of the Exchange Programme.
In the context of a stay with a host family or a host family stay, the terms “family”, “resident” or “household” can include a variety of constellations, including a two-parent family, a single parent or a blended family, as well as guests of different ages, with or without children. Emphasis is placed on ensuring that there is no discrimination of any kind based on race, religion, sexual orientation, ethnic, cultural, social or economic background or physical characteristics.
- Special conditions: Allergies, medical conditions and/or special diets
Placement in a host family can be challenging if the Participant suffers from allergies, has a special medical condition, or needs to follow a specific diet. It is essential that the Participant or their Legal Representatives disclose such matters in the pre-registration form and application form. It is not always possible to guarantee accommodation and catering that fully meets the specific needs of the Participant.
Applications with special needs will be assessed individually and in accordance with MyEducation’s policies. Whilst every effort will be made to secure a placement the following scenarios may occur:
- Placement not possible:
If placement is not technically possible, MyEducation will refund all amounts paid, provided that information about allergies, medical conditions, and/or special dietary requirements was provided at the latest during the selection interview. Failure to provide timely information may result in the usual cancellation conditions applying. - Placement possible but not guaranteed:
If a placement may be possible but not guaranteed, the Participant and their Legal Representatives must decide whether to confirm the entry. In certain circumstances there may be supplemental costs to cover the additional needs of the Participant, such costs are charged in accordance with MyEducation’s policies.
In all cases, MyEducation will inform the Participant and their Legal Representatives of the specific conditions as soon as the local partner has clarified the options. MyEducation will also specify a deadline for the Participant and their Legal Representatives to confirm whether they wish to participate in the Exchange Programme under the conditions described.
11. Release clause regarding US law
This release clause applies exclusively to Exchange Programmes in the United States of America, and claims that a Participant may have under U.S. law in any federal court or jurisdiction in the United States. For the avoidance of doubt, the Participant’s rights under UK law are in no way affected or limited by this clause.
The Participant (or parent/guardian if the participant is a minor under applicable law) agrees to release and indemnify the released parties for any claim that may arise as a result of the participant’s participation in the Programme. The “Released Parties” include MyEducation as well as its affiliates, directors, officers, shareholders, representatives, employees, and suppliers.
The Participant (or parent/legal guardian if the Participant is a minor under applicable law) further agrees not to sue the Released Parties for any claims related to participation in the Programme. This includes, but is not limited to, claims for negligence, breach of express or implied warranties, wrongful death, or any legal requirement, except in the case of intentional or grossly negligent acts on the part of the released parties.
Participant (or parent/legal guardian if participant is a minor under applicable law) also acknowledges and agrees that the Released Parties may, in their sole discretion, contact Participant’s parent, legal guardian or other emergency contact regarding health or other matters arising under the Programme, to the extent permitted by law. This release is binding on the Participant (or parent/guardian) and their personal representatives, heirs and family.
12. Force majeure
MyEducation and the Partner Organisation cannot be held responsible for events beyond their control or Force Majeure Events, whether they occur in connection with the departure or in the destination country.
MyEducation shall not be liable for any delay or failure in the performance of its obligations for so long as and to the extent that such delay or failure results from a Force Majeure Event. If the period of delay or non-performance continues for 30 days, then either party may terminate this agreement by giving not less than 14 days written notice to the other party.
13. Termination of contract in case of breach of rules or voluntary withdrawal from the programme
If the Participant breaches the terms of the contract, the Exchange Programme and/or the stay, the law, or if the Participant chooses to leave the Exchange Programme early, the contract will be terminated immediately. In such cases, the Participant undertakes to leave the Host Country within 5 days without the right to a refund from MyEducation. The participant must also indemnify MyEducation and its local partners for any damage, costs, expenses, or losses that may arise as a result of the Participant’s behavior.
The Participant also undertakes to fully repay any financial support from MyEducation that they may have received in connection with the Exchange Programme.
14. Processing of Personal Data
By entering into the terms of this agreement and for MyEducation to perform the contract and provide the Services, we collect information about you: Name, Birthday, Address, Phone Number, Email Address, Health Information and Information about the Participant.
Your personal data is processed for the purpose of delivering the selected Exchange Programme to you and handling any inquiries in connection with your purchase. The processing takes place in accordance with the rules in MyEducation’s personal data policy. In order to deliver the Services MyEducation uses Partner Organisations based overseas both inside and outside of the European Union. Whenever we transfer your personal data out of the UK to countries which have laws that do not provide the same level of data protection as the UK law, we always ensure that a similar degree of protection is afforded to it by ensuring that the appropriate safeguards are implemented. Your specific attention is drawn to Section 3, of the personal data policy.
15. Defects and Complaints
While on the Exchange Programme, the Participant must primarily contact his/her local contact person.
Should any problems arise during the stay, the Participant must immediately contact his/her local contact person of the Partner Organisation, who will be assigned before departure to the Host Country, so that any problems can be dealt with and resolved on the spot.
If no solution or intervention is found within 48 hours, the Participant and/or their Legal Representatives must immediately notify MyEducation by email or call so that MyEducation can intervene within the limits of its means to find a solution as soon as possible. If the Participant fails to contact MyEducation within a reasonable period of time and in any event within 24 hours of notifying the local contact personnel, then MyEducation may not be able to reasonably assist the Participant. MyEducation will rely upon any such delays when dealing with any subsequent complaints.
Any complaints and/or defect objections must be submitted in writing within 30 days of the end of the Exchange Programme. The complaint must be sent to MyEducations via email to info@myeducationuk.co.uk . If the Participant fails to submit a written complaint before the deadline, the Participant loses the right to invoke claims, defects or other rights against MyEducation and/or its affiliates.
The Terms and Conditions in force from time to time take precedence over any other written material relating to the Exchange Programme, including brochures, websites or other sources.
In the event of any conflict between the present Terms and Conditions and previous versions thereof or documents referred to herein, the present Terms and Conditions shall prevail.
If any part of these Terms and Conditions is found invalid or unenforceable by a court, the other provisions of these Terms and Conditions shall remain in full force and effect.
The legal relationship is governed by the laws of England and Wales. Any disputes regarding the contract or these terms and conditions will be determined exclusively by the Courts of England and Wales.
