Privacy Notice – All outbound/overseas programs​

  1. GENERAL

1.1. This policy on the processing of personal data (‘Personal Data Policy’) describes how MyEducation (‘MyEducation’, ‘us’, “our”, ‘we’) collects and processes information about you.

1.2. The Personal Data Policy applies to personal data that you provide to us in connection with your contact with MyEducation as a customer or business partner. This may be, for example, if you purchase a service from MyEducation, contact MyEducation’s customer service, have a meeting with one of our interviewers, use MyEducation’s website, www.myeducationuk.co.uk (‘MyEducationuk.co.uk), or visit MyEducation’s office(s).

1.3. MyEducation is the data controller for your personal data. All enquiries to MyEducation can be made via the contact details listed in section 7.

  1. WHAT PERSONAL DATA DO WE COLLECT, FOR WHAT PURPOSES AND THE LEGAL BASIS FOR THE PROCESSING

2.1. When you visit MyEducationuk.co.uk, we automatically process information about you and your use of MyEducationuk.co.uk. This information will typically be your activity on MyEducationuk.co.uk, what you click on, what type of browser you use, what search terms you use on MyEducationuk.co.uk, your IP address, including your network location, and information about your computer. In addition, MyEducation’s Cookie Policy applies when you use MyEducationuk.co.uk.

2.1.1. The purpose is to optimise the user experience and the functioning of MyEducationuk.co.uk, to generate useful and accurate statistics, and, based on the information we obtain from you through your use of MyEducationuk.co.uk, to carry out personalised marketing on MyEducationuk.co.uk and through our partners, if you have consented to statistics and marketing cookies. You can see which partners we use in section 3 and in our Cookie Policy.

2.1.2. The legal basis for the processing is your consent to our use of cookies and Article 6(1)(a) of the General Data Protection Regulation, as well as our legitimate interest in improving our website and making our marketing as relevant as possible, cf. Article 6(1)(f) of the General Data Protection Regulation.

2.2. When you purchase a service or communicate with us regarding our products/services, we collect the information you provide yourself. This may include your name, address, email address, telephone number, payment method, information about which products you purchase and any returns, information about enquiries and complaints, delivery preferences, and information about the IP address from which the order was placed, if the order was placed on MyEducationuk.co.uk.

2.3. Sensitive information may also be collected from you when you wish to travel with MyEducation. This is necessary in order to send our students abroad. This may include, for example, the interviews we conduct with our potential students, or the material you prepare to tell the host families about yourself and your family. Data may also be sent to our partner organisations in order to comply with our agreement with you.

2.3.1. The purpose is to enable us to deliver the products you have ordered and otherwise fulfil our agreement with you, including to administer your rights to return and complain, and to contact you if necessary with relevant information about the service you have purchased. We may also process information about your purchases to comply with legal requirements, including those relating to accounting.

2.3.2. The legal basis for the processing is Article 6(1)(b) of the General Data Protection Regulation and our mutual agreement on purchases from MyEducation, Article 6(1)(c) and our legal obligation to comply with legal requirements regarding withdrawals and accounting, as well as Article 6(1)(f).

2.4. When you chat with our employees on MyEducationuk.co.uk, we collect information about your name and the information you provide us while chatting with us, as well as the advice and recommendations you receive from us while chatting.

2.4.1. The purpose is to be able to advise you correctly about our products/services in relation to the questions you ask our employees and to market MyEducation products/services in this context.

2.4.2. The legal basis for the processing is your consent to participate in chat with our employees, cf. Article 9(2)(a) and Article 6(1)(a) of the General Data Protection Regulation.

2.5. When you visit MyEducation profiles on social media (Facebook, Instagram, LinkedIn, Google, YouTube, Snapchat, and TikTok), MyEducation may process the information you have made available via settings on our social media, your reactions to our posts, your sharing of them, and comments on our posts.

2.5.1. The purpose of MyEducation’s processing of your personal data is to market MyEducation on social media, including responding to your enquiries, allowing you to participate in any competitions we may run, and contacting you if you win. When the above-mentioned social media platforms use your personal data from MyEducation profiles for their own purposes, e.g. to improve their advertising system, they process your personal data as described in their privacy policies, which you can find here: Facebook/Instagram, Google/Youtube, LinkedIn, TikTok and Snapchat.

2.5.2. The legal basis for MyEducation’s processing is our legitimate interest in marketing MyEducation through MyEducation’s presence on the aforementioned social media and meeting our customers on the social media that the customers themselves already use, cf. Article 6(1)(f) of the General Data Protection Regulation.

2.6. If you enter into a commercial/business relationship with us, either as a private individual or as an employee of a company we work with, we will process information about your name, email address, telephone number, business or private address and any other information you provide to us in connection with our relationship and your enquiry.

2.6.1. The purpose of MyEducation’s processing is to maintain our working relationship with you and our business partner and to be able to fulfil MyEducation’s obligations in this regard.

2.6.2. The legal basis for this processing will normally be the contractual relationship that has been established or is being established between you and/or the company you represent and MyEducation, cf. Article 6(1)(b) of the General Data Protection Regulation. Depending on the nature of the cooperation, the legal basis may also be another, typically MyEducation’s legitimate interest in establishing and maintaining the relationship between you and/or the company you represent, cf. Article 6(1)(f) of the General Data Protection Regulation.

  1. RECIPIENTS OF PERSONAL DATA

3.1. If you have consented to statistics and/or marketing cookies, MyEducation uses third-party technologies, some of which are located outside the EU/EEA. These technologies are used to collect data for use in statistics, analysis and marketing on MyEducation channels and to optimise our advertisements outside MyEducationuk.co.uk. This means that if you consent to statistics and/or marketing cookies when you visit MyEducationuk.co.uk, our partners will receive certain information about you and your use of MyEducationuk.co.uk. When our partners use personal data collected on MyEducationuk.co.uk to improve their advertising system, they are independent data controllers and process your personal data as described in their privacy policies. You can find all our partners and links to their privacy policies in MyEducation’s Cookie Policy.

3.2. In connection with the delivery of services you have purchased from MyEducation, information about your name, address, email, telephone number, order number and specific delivery requests will be disclosed, for example, to the travel specialist or airline responsible for handling the trip. We will also send your information to the foreign family, school and partner organisation in the country you are travelling to.

3.3. When you pay a bill from us, this is done via Stripe and Revolut.

3.4. Information that MyEducation processes about you as part of a collaborative relationship will not be disclosed to third parties unless it is necessary for the purpose of the relationship or necessary for us to pursue a legitimate interest, e.g. in connection with disputes where the information may be disclosed to advisors, authorities and legal bodies.

3.5. Information may be disclosed to external partners who process the information on our behalf as our data processors or on their own behalf on the basis of joint data responsibility agreements. We use external partners for, among other things, technical operation of systems and improvements to MyEducationuk.co.uk, statistics, analysis, targeted marketing, and for your assessment of our company and products. We have entered into written data processing agreements with all data processors and joint data controllers who process personal data on our behalf or jointly with us.

3.6. To the extent that we use partners established outside the EU/EEA, this will be done in compliance with valid transfer guarantees in the form of the EU Commission’s standard contractual clauses, cf. Article 46 of the Data Protection Regulation or, for companies established in the United States, as a result of the American company’s affiliation with the EU-U.S. Data Privacy Framework programme (DPF). 3.7. We currently work with the following service providers outside the EU/EEA in relation to cookies. For each provider, we have specified the types of personal data that may be transferred to the individual provider and the purpose thereof:

  • Google, (USA). Purpose: Optimisation of advertising, analysis and statistics IP address without the last octet, cookie ID, session ID, user agent, information about your device, product ID, order number
  • Meta, (USA). Purpose: Analysis and statistics IP address, cookie ID, session ID, user agent, information about your device, order value
  • Microsoft Bing Ads (USA). Purpose: Statistics and optimisation of advertisements IP address, cookie ID, session ID, user agent, information about your device and order number
  • SnapChat (USA). Purpose: Analysis and statistics IP address, cookie ID, session ID, user agent, information about your device, order number

 

  1. YOUR RIGHTS

4.1. In order to ensure transparency regarding the processing of your information, we, as the data controller, must inform you of your rights

4.2. Right of access

4.2.1. You are entitled at any time to request information from us about, among other things, what information we have registered about you, the purpose of the registration, the categories of personal data and recipients of information, if any, as well as information about where the information originates.

4.2.2. You have the right to receive a copy of the personal data we process about you. If you want a copy of your personal data, please send a written request to info@myeducationuk.co.uk. You will be asked to prove that you are who you say you are.

4.3. Right to rectification

4.3.1. You have the right to have incorrect personal data about yourself rectified by us. If you become aware of any errors in the information we have registered about you, please contact info@myeducationuk.co.uk in writing so that the information can be corrected. You will be asked to provide documentation proving your identity.

4.4. Right to erasure

4.4.1. In certain cases, you have the right to have all or some of your personal data erased by us, e.g. if you withdraw your consent and we have no other legal basis for continuing the processing. To the extent that continued processing of your information is necessary, e.g. for us to comply with our legal obligations or to establish, assert or defend legal claims, we are not obliged to delete your personal data. If you contact info@myeducationuk.co.uk with a request for deletion, you will be asked to document that you are who you claim to be.

4.5. The right to restrict processing to storage

4.5.1. In certain cases, you have the right to have the processing of your personal data restricted to storage only, e.g. if you believe that the information we process about you is incorrect. You must contact info@myeducationuk.co.uk if you wish to exercise this right. You will be asked to document that you are who you claim to be.

4.6. Right to data portability

4.6.1. In certain cases, you have the right to have personal data that you have provided to us delivered in a structured, commonly used and machine-readable format and have the right to transfer this data to another data controller. Please contact info@myeducationuk.co.uk if you wish to exercise this right. You will be asked to provide proof of your identity.

4.7. Right to object

4.7.1. You have the right to object at any time to our otherwise lawful processing of your personal data, including in relation to direct marketing and the profiling carried out in order to target our direct marketing, as this processing is based on your consent and/or our legitimate interests, cf. sections 2.1, 2.3, 2.4, 2.5 and 2.7. If you do not want us to use your personal data for direct marketing and profiling, you must also delete your cookies, as mentioned in section 5.1 below. You must contact info@myeducationuk.co.uk if you wish to exercise this right. You will be asked to prove that you are who you say you are.

4.8. Right to withdraw consent

4.8.1. You have the right to withdraw your consent to a specific processing of personal data at any time, including consent to chat with an employee, to receive marketing from us or to cookies. If you wish to withdraw your consent, please contact info@myeducationuk.co.uk. You will be asked to prove that you are who you claim to be. Cookie consent can be withdrawn by clicking on the “cookie” icon in the bottom left-hand corner of MyEducationuk.co.uk.

4.8.2. If you choose to withdraw your consent, this will not affect the lawfulness of our processing of your personal data based on your previously given consent up to the time of your withdrawal. If you withdraw your consent, it will therefore only take effect from that point in time.

4.9. Right to complain

4.9.1. You have the right to lodge a complaint with the Information Commissioners Office about our processing of your personal data at any time. Complaints can be submitted through their website: https://ico.org.uk/make-a-complaint/data-protection-complaints/ or by telephone on 0303 123 1113.

  1. DELETION OF PERSONAL DATA

5.1. Information collected about your use of MyEducationuk.co.uk in accordance with section 2 will be deleted in accordance with the rules in MyEducation’s Cookie Policy. The individual expiry dates are listed in MyEducation’s Cookie Policy, where you can also read more about how you can delete your cookies yourself when you wish to do so.

5.2. Information collected in connection with your purchases and enquiries to MyEducation in this regard, cf. section 2, will, as a rule, be deleted just over 5 years after your purchase, when the right to complain about the product has expired. However, information may be stored for a longer period if we have a legitimate need for longer storage, e.g. if it is necessary to establish, assert or defend legal claims, or if storage is necessary for us to comply with legal requirements.

5.3. Information about you from your use of online chat with our employee in accordance with section 2 will be deleted after 60 days.

5.4. Information you provide on MyEducation profiles on social media, cf. section 2, will generally remain on these profiles as part of the page’s history, unless you delete it yourself. The information that MyEducation processes about you as a result of your participation in competitions, and which is copied into MyEducation’s own systems in this connection, is typically deleted after 3 months.

5.5. Information originating from a collaborative relationship, cf. section 2, is stored for as long as it is relevant to the existing or potential collaborative relationship and for a subsequent period as long as it is necessary for MyEducation to document the relationship.

  1. SECURITY

6.1. We have implemented appropriate technical and organisational security measures to prevent personal data from being accidentally or unlawfully destroyed, lost, altered or degraded, and to prevent it from becoming known to unauthorised persons or being misused.

6.2. Only employees who have a genuine need to access your personal data in order to perform their work have access to the information. These employees have been instructed on how to process personal data in a responsible manner.

Privacy Notice – Area Representative

Why do we collect information about you?

We need to collect and process personal information about you:

  • ​to respond to initial enquiries from you about acting as an Area Representative;
  • ​to make an assessment of your eligibility and suitability to be an Area Representative; and
  • ​to provide you, the student and the host family the support and services you all need while participating in the program.

Provision of the personal information is a requirement under the agreement you have with us as an Area Representative.

The principal lawful reason for collecting and processing your personal information is to fulfil our agreed obligations to you or because you have expressed an interest in entering into an agreement with us. In addition, we ask you to confirm that you have read and understood this Privacy Notice and that you consent to your personal information being collected and processed for the reasons we have given. In some instances, we also have a legitimate interest in processing your data as part of maintaining a relationship with you, for example, if you have requested to join our email list.

We do not use your personal information for automated profiling or decision-making.

What information do we collect about you?

The personal information we collect and process for each Area Representative is set out on the forms that we ask you to complete. We also gather information through supplementary email correspondence, interviews and telephone conversations with you, and from the references you are asked to provide.

Who receives your personal information?

All of the personal information you provide is received by My Education (UK) Ltd.

Who do we share your personal information with?

Information provided by you to fulfil preliminary enquiries or to make an assessment of your eligibility and suitability as an Area Representative might be shared with a current Area Representative who will interview you and collect your identification documents to complete your Disclosure Barring Service or Disclosure Scotland application.

Once you have successfully completed the process of becoming an Area Representative, we share relevant personal information with the following people and organisations:

  • ​the students and host families who you will support in the role;
  • ​the local school that will be hosting the student(s) you support; and
  • ​our partner companies overseas.

The partner company will share the relevant parts of your personal information with potential exchange students and their parents or guardians.

In order to share your details with our arriving students, we must send your data out of the UK to our partner companies. It is important that you understand that data protection regulation in other countries might be different from that in the UK and less rigorous.

How long do we hold your personal information?

If you do not complete the process to become an Area Representative then we delete your personal information two years after the information was received.

If you become an Area Representative then we retain your personal information for six years after you cease supporting students with us.

What are your rights with regard to your personal information?

At any time that we are in possession of or are processing your personal information you have the following rights:

  • ​the right to access your personal and supplementary information and to receive a copy of that information free of charge;
  • ​the right to have incorrect or incomplete personal information rectified or completed, within one calendar month of correction or completion being requested;
  • ​the right, in certain circumstances, to ask for your personal information to be erased (details of the circumstances will be supplied on request);
  • ​the right, in certain circumstances, to restrict the processing of your personal information (details of the circumstances will be supplied on request);
  • ​the right to have the information we hold about you in electronic form transferred, free of charge, to another organisation within one calendar month of a request being made;
  • ​the right to object to your personal information being used for certain purposes, for example, direct marketing.

What are your rights of complaint?

If you are not satisfied with the way in which we collect or process your personal information you should complain to us by contacting our Country Manager using the contact details on this website.

If you are not satisfied with our response to your complaint you have the right to lodge a complaint with the supervisory body for the United Kingdom, which is known as the Information Commissioner’s Office (ICO). Instructions for contacting the ICO can be found on its website at https://ico.org.uk/global/contact-us.

Use of Cookies

This website uses cookies to improve the users’ experience while visiting the website. Where applicable this website uses a cookie control system allowing the user on their first visit to the website to allow or disallow the use of cookies on their computer/device. This fulfils legal requirements for websites to obtain explicit consent from users before leaving behind or reading files such as cookies on a user’s computer/device.
